试论司法解释的价值标准

在我国,司法解释背离法的基本价值的现象时有发生,不但损害了诉讼当事人的权益,也造成法律信仰的危机。司法解释应符合“良法”标准,体现正义、公平、民主等法律的基本价值,可以保证司法解释的科学性,提高司法解释的质量。司法解释的目的就是要查明法律中所包含的立法者的价值判断,使司法解释既能解决社会实际问题,又符合立法本意。良好的司法解释应以完备的司法解释程序和监督机制作保障,才能树立法律的公正与权威,有助于法治状态的形成。

Value Criterion for Judicial Interpretation

It occasionally occurs that judicial interpretation deviates from the basic values,thus the litigants interest is jeopardized,and the legal religion is on crisis.So judicial interpretation should act in accordance with the conscientious law criterion,and embody the basic values like justice,equality.Moreover,the corresponding procedure and mechanism should act as guarantee so as to set up the just and authority of law to promote the formation of rule by law.
