| 摘 要： | 针对我国刑事诉讼中所存在的超期羁押、刑讯逼供、诱供、以捕代侦、审而不判、判而不审等程序问题,首先要重塑价值理念、制定一套体现“正当程序”精神的诉讼规则,其次要确立刑事正当程序的实施与保障机制。

| Abstract: | Criminal suit can be divided into two patterns: crime control and legitimate procedure. The legal value the latter reflects is the pursuit of modern country ruled by law. Against the problems of extorting a confession, inducing to confession,capturing instead of investigating, interrogating and not convicting, convicting and not interrogating, first of all, it is to rebuild concepts of value and work out a set of suit regulation reflecting legitimate procedure. It is also necessary to set up a mechanism of guaranteeing the enforcement of criminal legitimate procedure. |
