| 摘 要： | 对刑事见证人法律地位的明确以及资格的科学界定是程序正义的必然要求与具体体现，然而，《刑事诉讼法》的最新修订及其司法解释并没有完成这一任务。文章以H省Q县调查材料为基础对我国刑事见证人法律地位进行研究，为我国刑事见证制度的完善提供一定的方法和思路。

| Abstract: | On criminal witness clear scientific definition and eligibility for legal status is the inevitable requirement for procedural justice embodied, however, the latest revision of the criminal law and its judicial interpretation do not accomplish this task. In this paper, the H Q in the county based on investigative materials to study the legal status of criminal witness in China, for perfecting the system of criminal witness in China provide some methods and ideas. |
