论我国举证时限制度的立法缺陷与完善

随着最高人民法院《关于民事诉讼证据的若干规定》的公布,规定了《民事诉讼法》中关于举证时限制度存在的一些问题,但仍然暴露了逾期举证的法律后果过于严厉,举证时限制度配套制度不健全,当事人的举证能力得不到保障这些立法缺陷。然而要不断修改和完善这些立法缺陷,就必须通过举证时限制度由法律来直接规定,设立与完善举证时限的配套制度,扩大当事人、律师的调查取证权来改善这些现实问题。

Reflections on the Legislation Defects and Perfecting the Time Limit of Proof in China

The Regulations on Civil Action Evidence,promulgated by PRC Supreme Court,states some problems of the system of time limit of proof in Civil Procedure Law.However,it still reveals legislation defects like：too severe of the legal result of late proof,the incompleteness of the accompanying systems to time limit of proof,no insurance for the proof ability for the party.In order to make amendments and perfect these legislation defects,time limit of proof system should be directly stated by law,set up and perfect the accompanying systems to time limit of proof, and enlarge the rights of obtaining evidence for both the party and the lawyer.
