浅析知识产权法律保护制度以及存在的问题

加入WTO后,中国严格按照TRIPS的要求从实体和程序两方面加大知识产权保护力度。用知识产权对外投资中出现的法律问题更是要求我国分析和掌握其他国家和国际上对知识产权的法律规定。在符合我国实际的基础上,分析我国与其他国家和国际上知识产权法律规定的差距可以逐步完善我国知识产权法律制度。完善重点应放在执法和司法制度上。

Analysis of China's Legal Protection System and the Problems of Intellectual Property Rights

After entering into WTO,according to the requirements of TRIPS,in the substantive and procedural aspects,China has forcefully strengthened the intellectual property protection.The legal issues arising from foreign investment in intellectual property require China to analyze and master the other national and international legal provisions on intellectual property rights.In line with our real situation,analyzing the gaps in intellectual property law between China and other countries can gradually improve China＇s intellectual property rights legal system. In particular, the focus should be put on law enforcement and judicial systems.
