土地承包经营权初探

土地承包经营权是我国经济体制改革后农业生产责任制的核心内容，随着农村经济体制改革的深入，以土地承包经营权为核心的家庭承包责任制逐步得以形成和完善。但是，由于立法的滞后，在理论和实践上，对该权属的名称、性质以及流转等问题存在着很大的争议。文章试图以此为起点，对农村土地承包经营权的权属性质、现行制度的弊端作比较分析，在此基础上提出完善农村土地承包经营权若干法律建议，并对2002年8月29日全国人大常委会通过，并将于2003年3月1日实施的《中华人民共和国农村土地承包经营法》作简要评述。

An Analysis of the Right of the Management of Contracted Land

With the implementation of the reform in the rural economic system in china, the system of contracted responsibility linking remuneration to output of which the core is the right of management of contracted land has come into being and been perfected. But due to the delay of the legislation which has become a very urgent task in this area, there are still controversial issues on the nomination, the nature and the method of transferring of the right. In this article the author tries to provide some legal advices based on the analysis of the problem, and give a concise comment on the Law of the Management of Contracted Land which will be enforced in March 1 st ,2003.
