| 摘 要： | 缔约过失责任是与合同相关，但又不同于合同责任的一种特殊的民事责任，随着商品经济的发展，它为许多国家以判例、立法等形式加以肯定，我国统一合同法对此加以确认，但规定的较为简单，本文从缔约过失责任的产生，缔约过失责任与违约责任、侵权责任的区别，构成要件以及表现形式几方面对此加以阐述。

| Abstract: | Duties of Culpa in Contrahendo are associated woth the contract,but they are different from the special civil duty of the contract duties.With the development of commodity economx,they atree with the legal precedent and legislation in many countries.The contract law confirms them in our conntry,but the stipulations are comparatively simple.The essay mainly stimulates their origin,their differences from the duties of breaking a contract and vioalting a right,their important components and forms. |
