| 摘 要： | 榷茶法是禁榷法的一种，起源于唐，兴于宋。宋代四川茶叶运销的法律规定主要有三种：通商法、茶马法、茶引法。相对于“书本上的法”，我们更应重视“实际中的法”。考察宋代四川茶马法的运作情况，可见一些利于资本主义萌芽的因素。但从总体上看，宋代的榷茶法阻碍了资本主义萌芽的产生。

| Abstract: | The Monopolizing- Tea Law is one kind of the Monopolizing Laws, which originated in Tang Dynasty and flourished in Song Dynasty. Laws for transporting and selling of tea in Sichuan in Song Dynasty were divided into law for Having Trade Relations,Tea- Horse Law and Chayin law. We must pay more attention to the law in practice than that in books. The paper focuses on the study of Sichuan Tea- Horse Law in Song Dynasty in operation and reveals that there were some factors benefiting the sprouting capitalism in Sichuan tea circle in Song Dynasty, but Sicuam Monopolizing- Tea law, on the whole, impeded the sprouting of capitalisru. |
