道路交通事故人身损害赔偿相关问题初探

2004年5月1日开始,《中华人民共和国道路交通安全法》、《中华人民共和国道路交通安全法实施条例》、公安部《交通事故处理程序规定》均开始实施,使用了近14年的《道路交通事故处理办法》同时宣告废止,新旧法律法规的取舍,使得道路交通事故人身损害赔偿案件的法律适用发生了显著的变化。也出现了诸如交通主管部门对交通事故认定行为的性质如何、交通事故认定书能否直接作为民事和刑事案件责任承担依据、现行机动车辆第三者责任保险是否就是《道路交通安全法》所称的机动车第三者责任强制保险、在司法实践中,对于因交通事故而死亡的受害人如何进行死亡赔偿金的支付等问题。时这些问题,应给予澄清和解决。

On the Related Problem of Human Body Damages in Road Traffic Accidents

Since May 1st, 2004, Law of The People's Republic of China on Road Traffic Safety, Regulations for Implementation of Law of The People' s Republic of China on Road Traffic Safety, Provisions on Handle Procedure of a Traffic Accident (Revised by Public security official) all have been put into effect, and as a result, it also announced the abolition of Measures on Settlement of a road traffic accident which had been carried out for 14 years at the same time. The replacement of laws makes great changes in the application of laws which invovles cases of human body injury in traffic accidents. For example: How do the departments in charge of traffics affirm acts in law of traffic accidents? Can affirmation letter be adirect evidence of civil or criminal cases? Is the present third party liability insurance of motor vehicles the same as the so-called third party liability forced insurance of motor vehicles in Law of The People's Republic of China on Road Traffic Safety? In judicial affairs , how can damages of death be paid to those victims in trraffic accidents? All these problems need to be cleared up and solved urgently.
