| 摘 要： | 《刑法》第50条中的“故意犯罪”不应包括自诉案件,“故意犯罪”的查证属实应当由中级以上人民法院依法进行。死刑缓期执行期间怀孕且有故意犯罪的妇女,不能核准死刑。应以法定事由发生的先后作为死缓变更的依据,解决死缓罪犯在死刑缓期执行期间既有“故意犯罪”又有“重大立功表现”的冲突。

| Abstract: | "An intentional crime" in article 50 of criminal law should not include private prosecution cases, "an intentional crime"should be investigated and verified by a people's court at or above the intermediate level. Women crime who become pregnant and commit an intentional crime should be approved. Relating organs, should base on time sequence occurring to legal main content, to resolve the contradiction which a crime within the suspension of execution of a death penalty commits "an intentional crime"and also performs "major meritorious services". |
