| 摘 要： | 中国古代会审制度源远流长,其雏形最早出现在西周,其制度则在汉代成形.历经几千年的发展演变,会审制度至明清时形成完备形态.其形成主要是因历代统治者推行慎刑法律原则和中央集权的政治策略.会审制度虽是统治者仁政的形象标榜,但在预防冤假错案,防止刑法滥用方面发挥了积极的作用.

| Abstract: | The ancient Chinese trial system has long history, beginning in the Xizhou period and formed in the Han dynasty. After sever- al - thousand - year evolution, the trial system was perfected in the Ming and Qing dynasties. The main causes for its coming into being were that generations of rulers promoted prudent criminal legal principle and political strategy of central concentration. Although the trial system was the image mark of merciful ruling of rulers, it played an active part in preventing wrong convictions and abuse of criminal punishments. |
