我国建立辩诉交易制度的双向分析与理性思辩

分析了辩诉交易制度在我国建立后对刑事诉讼带来的影响，认为辩诉交易由于与我国法律传统文化、诉讼模式、诉讼制度具有内涵一致性，因而具备了移植的可行性。但同时认为我国对辩诉交易应持理性思辩的态度，不应停留在讨论的层面，而应大胆将其付诸实践，不断探索，以建立适合中国国情的辩诉交易制度。

Two-way Analysis and Rational Thinking of Establishing Plea Bargaining System

Based on the influence on the criminal proceedings after the establishment of the plea bargaining system in China,plea bargaining is considered possible to transplant in China due to the consistency with the traditional culture of law,litigation mode and litigation system.At the same time,it is considered that China should take a serious attitude on plea bargaining not be limited within in the discussion.We should put them into practice and create suitable plea bargaining for China.
