试论知识产权与企业自主创新

没有自主创新，就谈不上自主知识产权。技术创新是企业获得专利的重要前提，技术创新过程本身也是一个获得专利等自主知识产权的过程；从专利制度赋予企业的专利保护和激励发明创造的功能，以及由此给企业创造的巨大利益。不难看出知识产权制度是企业自主创新的重要动力之一：知识产权制度的核心是保护知识产权不受侵犯．因而企业不会因为技术创新成果申请专利后，被他人擅自仿造，从而有利于营造企业公平竞争的环境；新技术的商品化和产业化，是技术创新的根本目的。专利制度把保护和鼓励技术发明的商品化作为根本出发点，调动了科技人员将其技术创新成果市场化的积极性：专利制度鼓励发明创造尽早公开。在公开的情况下对发明创造进行法律保护，企业完全可以在最大限度降低创新成本的前提下，充分利用和合理配置研究与开发的资金、人力和设备等创新资源。

Discussion on Intellectual Property and Enterprise Independent Innovation

wtihout independent innvation ,there's no independent intellectual property. Technique innovation is a significant precondition for an enterprise getting potent , also the process of technique innovation is the process of obtaining independent intellectual property. Through the function of potent protection &innovation inspiration which authorized by the pontent system ,also the huge profits could be brought about. it is clear that intellectual property system is one of the key points of enterprises independent innovation. The center of intellectual property system is to protect the property from being infringed,therefore the potent could avoid being imitated after its application,so as to create a fair competitive environment finally. The radical goal of technique innovation is to realize its commercialization &industrialization. Setting the protection &innovation inspiration of technique innovation as its starting point. Potent system can greatly mobilize science personnel's initiative of fruit industrialization. Potent system encourages the openness of innovation as soon as possible,and offers legal protection under this condition. In this case, enterprise could configure and make the best use of the funds,personnel and equipment ,while spending less money.
