| 摘 要： | 作为一种人才培养模式,工学结合要求学生在真实的工作环境中参加工作。职业院校学生在工学结合的过程中受伤案件时有发生。工学结合中的学生与用人单位之间构成劳动关系或者劳务关系,适用《工伤保险条例》或者其他民事法律。我国法律对工学结合中学生伤害事故缺乏规定,应当加以完善。

| Abstract: | As a kind of personnel training mode,work-study integration requires the students to work.in real work environment.The students from vocational colleges are injured now and then in the process of work-study integration.The students and enterprises form labor relationship of which Work-related Injury Insurance Regulations or other civil laws are applicable.There are no special regulations on students＇ injure in the process of work-study integration and the situation should be improved. |
