| 摘 要： | 风险在任何情况下、任何商业活动中都存在.建筑施工是一种非常复杂的业务.指导原则、建议、法规、合同甚至法律裁决等都仅仅提供了一种判断特定情况的方向.施工参与各方必须要在施工开始前,坐下来一起讨论风险责任、风险承担和风险分配,这样可以更好地理解建筑施工带来的风险.一些风险可能会通过合阿转移给另一方.但是,需要知道的是,所有的风险都应由业主承担,除非是在公平补偿的情况下转移给另一方,由另一方来承担.判断风险是否应该转移给另一方的主要指导原则是看这一方是否同时具有评价风险的能力和控制或者最小化风险的必需的专业知识.
