法学类型化研究方法的基础问题研究

类型化研究向来不是重要的法学方法,类型化分析也尚未成为独立的法学流派,但现实中类型化作为法学的重要研究方法已经得到了广泛的认可,深受理论学者和司法实践工作者的欢迎,近来类型化研究已成蓬勃之势,公法和私法、实体法和程序法等部门法以及部门法内部类型化的研究成果层出不穷,但理论界要求扩大类型化研究方法适用的呐喊之声一直不绝于耳。笔者从法学方法论的角度,分析类型化研究方法的内涵,明确类型化研究的价值,冷静地分析类型化研究的缺陷,力求正确地认识类型化研究方法。

Fundamental Problems in the Research Methods of Law Categorization Study

categorization methodology has never been considered as an important method of law study, and it has not yet been an independent school of law. But in reality, it has been widely accepted and warmly welcomed by the theorists and the judicial practitioners. Especially in recent years, relative research has blossomed and gained in achievements. Hence, the theoretical circle calls for expanding the application range of categorization methodology. This paper, from the perspective of jurisprudence methodology, analyzes the connotation of the research method; specify the value of categorization methodology, and sums up its defects, in hope to provide a more comprehensive understanding towards categorization methodology.
