| 摘 要： | “家庭型”共同受贿犯罪由于犯罪主体关系的特殊性,它比普通的共同受贿犯罪更具复杂性,特别是在实践中对刑法有关条款的理解和对共同犯罪理论的具体应用尚存争议,如何认定国家工作人员与其家属具有共同受贿行为和共同受贿故意,已成为当前困惑司法实践的一个难题。

| Abstract: | Due to the uniqueness of the objects relationship,the family type co-bribery crime is more complex than normal criminal case especially from the arguing perspective of understanding of the terms of criminal law in practice and application.Hence to identify the behaviors and intention of co-bribery crime of workers in national organizations with their relatives has become a conundrum confusing the judicatory practice. |
