论我国经济立法中的法律移植——中国借鉴外国法律问题研究系列论文之三

法律移植的讨论在我国始于８０年代中期，并日渐成为法学界的一个热点问题。文章通过对法律移植涵义的辨析，澄清了人们对其的误解。法律移植有风险因素的存在，我们必须正视、分析、论证其对移植的阻力。文章论证了在我国立法中法律移植的可行性和必要性，认为法律移植是建立和完善社会主义市场经济法律体系的一条重要途径。经济法律移植必须立足本国，洋为中用，学有发展，把移植的法律融入我国的法律体系，为经济建设服务。

A Discussion about Law Transplant in Economic Legislation in China

The discussion about law transplant began from the middle age of 80' s, amd it has become a focus question in the law kingdom gradually. The article has cleared the misunderstanding by analyscing the conception of law transplant. We must face, analyse and prove the resistance to the transplant considering the risk factor in law transplant. The article also has proved the feasibility and necessity of the law transplant in economic legilation in China, and regarded the law transplant is a important pathway that establish and perfect the socielism market economic law system . Economic Law transplant must base on nation, make foreign things serve China, research advanced , and melt the transplanted law into country's law system , and serve the economic construction.
