大规模侵权几个基本问题探讨

大规模侵权是高度风险社会新型侵权方式之一,在我国工业化进程日益加快的情形下研究这种侵权行为迫在眉睫。界定大规模侵权的概念要解释和描述其案件受害人人数、因果关系、赔偿数额、处理结果具有较大不确定性的核心特征以及同质性的受损原因。大规模侵权除核心特征外,还具有受害主体呈潜在性和缓释性、救济困难、损害后果严重、案件处理复杂等特点;应当建立无过错原则占有主导地位、过错原则处于从属地位兼有过错推定原则的多元化归责体系;其主要分布在产品责任、医疗责任、环境与生态保护责任、证券欺诈与虚假陈述等领域,在适用时先把自然灾害、矿难以及侵权特别法有明确规定的情形排除之外,再考虑受害人人数和损害数额因素。
