装备采购中的知识产权权益归属研究

随着我军装备的科技密集程度和系统复杂程度越来越高，知识产权在装备建设中的贡献变得越来越大。目前，部队现有的知识产权制度还不完善，其中以知识产权归属和使用界定不清晰，权益分享、义务分担不明确最为突出。文中提出了装备采购中的知识产权的概念，并分析了其特征，指出我国装备采购中的知识产权权益归属存在的f＊q题，认为知识产权的保密性、研制资金来源和研制方性质的不同将会导致国家、研制方和使用方对装备采购中的知识产权拥有不同的权利。

On intellectual property right ownership of military equipment acquisition projects

With the development of technology in military equipment, the intellectual property right becomes more important. But the present system of intellectual property right is still not perfect. It is obvious that the ownership isn＇t clear, and the right and the obligation are not definite as well. This paper puts forward the concept of intellectual property right ownership of military equipment acquisi- tion projects, and analyzing its characteristics as well.
