| 摘 要： | 《晋书.刑法志》是“二十五史”《刑法志》中文字最好、学术价值较高的一篇法学专论,它记载自春秋战国至晋朝的法律编纂体例变迁,历代关于“肉刑”废复的讨论,当时两大法学家刘颂和张斐的两种不同司法主张,以及法律儒家化的渐进过程。
