论审判质量——以质量管理为视角

审判质量对于法院和法官来说至关重要，为了应对审判工作的需要，现阶段加强审判质量管理成为法院工作的重点之一，但是审判质量管理存在一定的局限，如行政元素的增加可能妨碍审判质量的提高，抑制法官独立负责品格的形成等。因此，在审判质量评查指标体系的构建时应当合理设置各项指标，使对法官的积极评价和消极评价、整体评价和个案评价、内部评价和外部评价相结合，形成体系完整、结构合理、评价公正、不断更新的指标体系，并注重信息技术在审判质量管理中的应用，真正使质量管理能够促进审判质量的提高。

On the Quality of Trial and Conviction from the Perspective of Quality Management

The quality of judicial trial and conviction is essential to courts and judges. In order to meet the requirement of improving the trials and convictions, it has become a stress to enhance the management of courts. But at present, the management of trials and convictions is restricted by some factors, such as the obstacles to the quality of trials by the multi- sections of administration and constraint to the independence of judges in responsibility. Therefore, a reasonable assessment system for judges＇ trials should be established with the combination of passive assessment with negative assessment, interior assessment with exterior assessment with integral case assessment with single case assessment. It is also necessary to construct an integral, reasonable, just and renewable index system. Besides, the importance should be attached to the management of IT so as to improve the management and in turn to upgrade the quality of trials and convictions.
