论对精神损害赔偿制度的完善

目前我国的精神损害赔偿制度具体规定，仍需进一步完善。精神损害赔偿制度的确立有其必要性，并且其适用范围应进一步扩大，精神损害赔偿数额的确定也应有所限制，而又确定时要给与法官一定的自由裁量权，赔偿标准应从损害程度、损害结果、致害人、受害人、客观方面、双方主观方面等角度综合确定。

Thoughts on the compensation system of spiritual damage

At present,in our country the damage compensation in spirit system has not been stipulated in detail and still need improving.On this question,the author has put forward some ideas.First of all ,to lay down the system is necessary.Secondly,the system application scope should be extended.Thirdly, the compensation amount should be limited and the moderate freedom given to judges.Finally,the standard to determine the amount should be measured according to the damage degree,to the inflicter,the sufferer,the objective and the subjective aspects as well.
