| 摘 要： | 随着名誉权、隐私权等侵权纠纷的增多，精神损害赔偿已成为社会关注的热点，但我国法律目前对此制度尚无明确统一的规定，精神损害赔偿具有经济补偿和精神抚慰双重性质，成构成要件、适用范围和基本原则方面一般侵权行为相比具有不同的特点。本文对我国审理有关精神损害赔偿案件具体适用法律问题进行探讨。

| Abstract: | The increasing of the dispute of infringing upon human rights of frame and privacy makes the mental compenastion the focus of social attention, but in China there is still no unified stipulation with the system for mental compenastion has dual character of economic compersation and mental comfort while having special character differs from the general action of infringing in the construction of important conditions, the range of application and the basic principles. This article answers the questions of applying law on the case of mental compensation. |
