居民提前交付集中供热采暖费研究

我国北方集中供热地区，在居民提前交付采暖费后，供热价格发生上涨时，居民与供热单位就是否应补交采暖费差额部分存在争议。供热单位认为根据《供热合同》及合同法的相关规定，居民应补交采暖费差额部分；笔者认为将供热单位收取居民提前交付采暖费视为一个新的合同。并按照该生效合同处理双方争议更为合理。
