| Abstract: | The case laws is the main source of the common law. The enactment law is the only source of law in our country. The jurisprudence system will inevitably need to build the rule of law because case law is the driving force for development and the point to the new law. Establishing jurisprudence system is not only the effective way to remedy the vacancy of legislation in China andto fill the hole in law, but also the effective means to maintain the unity of law system in China and to realize the justice of judicature. |
