| 摘 要： | 关于死刑废止问题古今中外刑法学者们从多角度对其正当性进行了探讨。而笔者以新的视角,即运用微观经济学的概念、理论、方法分别对死刑废止经济分析的必要性、死刑制裁的成本、死刑制裁的收益三个问题进行了探讨,得出死刑废止正当性的结论。

| Abstract: | The ancient and modern criminal scholars in China and foreign countries have discussed the justifiability of abolishing death penalty from various perspectives. The author of the paper, from fresh perspective-the concept, theory, and approaches in microeconomics-analyzes the necessity of abolishing death penalty, the cost and benefits of death penalty. It concludes that the abolition of death penalty is justifiable. |
