论我国住房保障法律制度的完善

住房是人类生存不可缺少的基本物质要素，关系着人们的安居乐业和社会的和谐稳定。我国的基本国情是中等和低收入家庭数量多，土地资源有限，住房需求大于供应现象，市场机制无法解决中等和低收入家庭的住房问题，因此，国家应对住房市场进行干预，保障居民的住房权。住房权是一项基本人权，理应得到国家的尊重和保障。笔者对我国的住房保障法律制度的完善，提出一些可行性建议，旨在对我国的住房保障法律制度有促进作用。

The Perfection of Chinese Housing Security Legal System

Housing,which is indispensable,is a basic material condition for human survival,concerning people’s pleasant living and social harmony and stability.In China,the large number of middle and low-income family and limited land resource result in the phenomenon that housing demand is greater than supply,while market mechanism can not solve the majority of middle and low-income family housing,which requires the government to make intervention with the housing market so as to guarantee residents’ housing authority.Housing right,as a basic human right,should get respect and guarantee.This paper puts forward some feasible suggestions on the way of perfecting legal system of China’s housing security,hoping to promote China’s housing security legal system.
