| 摘 要： | 专利禁止反悔原则从弃权理论发展而来，与专利等同原则并不具有天然的限制与被限制的关系。禁止反悔原则的发展表明其并非绝对作为等同原则的限制性工具，禁止反悔原则的适用在结果上恰好与对等同原则的限制存在某种契合关系。

| Abstract: | Patent prosecution history estoppel derived from the concept of waiver has no direct connection in limiting the application of the doctrine of equivalent naturally.The development of patent prosecution history estoppel indicates that it is not merely acting as a restrictive tool to the application of equivalent.More importantly,it corresponds to the limitation on the doctrine of equivalent from our study of its results. |
