我国死刑复核程序理念的实然与应然

长期以来,我国以死刑刑事政策为理念建构死刑复核程序引发了一系列问题,对死刑复核程序的改造必须首先从理念上实现转变.以程序正义观念代替死刑刑事政策作为死刑复核程序的建构理念、以司法权的运作规律代替行政权的运作规律作为死刑复核程序设置的基础、以权利救济型程序代替政策实施型程序作为死刑复核程序的模式,并走渐进化改造之路,才能实现我国死刑复核程序的根本改革.

Existent Form and the Ideal Form of the Procedure for Review of Death Sentences

For a long time,regarding the Death Penalty Policy as the ideas of the Procedure for Review of Death Sentences of China has caused much troubles.So we should change our ideas of the Procedure for Review of Death Sentences of China if we want to settle those problems.That is to change the ideas of the procedure from the Death Penalty Policy to Procedural Justice,to change the rules of the procedure from the administrative power's to the judicial power's,and to change the mode of the procedure from the mould of policy executing to the mould of right redressing.
