立法后评估的方法探析

立法后的评估是指针对一部或几部已经实施了一段时间的法律,政府有关部门或相关组织对法律的立法质量和实施效果进行评价、估算,以期找出法律在实施中存在的问题,分析其立法上的原因,从而进一步完善立法。立法后的评估是法律实施后不可或缺的环节。我国从2004年开始各地开展了立法后评估的实践,但是纵观各地的实践,方法不一、标准不同。为此,应明确立法机关的评估主体地位,评估对象的选择要有针对性,评估标准主要采用可行性标准和效益标准,综合采用各种评估方法,从而提高各地评估水平。

Exploration on the Method of Evaluation after Legislation

The evaluation after legislation is to evaluate the quality of the legislation and the effect of the implementation of one or several laws which were practiced for some time by the relevant departments of government or organization in order to find the problems during the implementation of the law,analyze the reasons of the legislation and improve the quality of the legislation.The evaluation after legislation is an indispensable step after legislation is implemented.Since 2004,the evaluation after legislation has been implemented in China.However,the different methods and the different standards were used in different regions.The legislature must be on the dominant position in the practice.The selection of the assessment of the objects should be targeted.The feasibility standards and efficiency standards are the main evaluation criteria.The level of assessment can be improved by using a variety of assessment methods comprehensively.
