国家科技报告制度中的知识产权保护问题研究

知识产权专有性与数据共享性存在冲突,但并非不可协调。二者协调的基础是知识产权制度和数据公开在目标上具有一致性。我国的科技报告制度已进入实质运行阶段,并采取了四种措施来保护知识产权权利人的利益,但仍有不足。本文认为可以进一步完善商业秘密的保护制度、科研报告管理人员的责任制度和利益相关方的异议制度。

Analysis on the Intellectual Property Right Protection in the National Science and Technology Report System

Conflict exists between the monopoly of intellectual property and the sharing of information. However, it can be reconciled on the basis that the intellectual property and the open information have the same target. Our national science and technologyreport system has been in the actual operation stagenow and taken four measures to protect the interests of intellectual property right holders. But, the protection measures still can be improved. This article suggests that we could improve the business secret protection system, the liability regu?lation of the national technical report administers and the objection procedure of the interested parties.
