现代城市精神与法治的关系探析

马克斯·韦伯在其著作《新教伦理与资本主义精神》中提出,资本主义取得如此成就的关键因素在于具有内在合理性的资本主义精神的支撑,而新教伦理对资本主义精神的形成起着决定性的作用。这种观点对于中国的城市化有借鉴作用。我国新一轮的城市发展需要有城市精神来引导,其中城市法治正是现代城市精神的深层底蕴。城市精神在现代中国城市发展中的根本社会意义,就在于通过城市法治化过程中所形成的习惯、风俗和道德,构建一个理性自觉的社会秩序。

STUDY ON THE RELATIONSHIP BETWEEN THE URBAN SPIRIT AND THE URBAN RULE OF LAW IN MODERN CITY

Max Weber proposed that the key of success in capitalism was the supporting by the spirit of capitalism, in his book ＂The Protestant Ethic and the Spirit of Capitalism＂. He also pointed out that the protestant ethic played a decisive role in the formation of the spirit of capitalism.. Reference to the new round of urban development in China, we need the urban spirit to guide our advance. And precisely, the urban rule of law is the deep spiritual heritage of the urban spirit. So the fundamental social significance of the urban spirit in China, is to build a rational and conscious social order by forming some new customs and morals, in the process of the urban rule of law.
