| 摘 要： | 顶岗实习作为职校教育的重要环节,是校企合作的主要形式,成为发展职业教育不可或缺的要素。但是,随着职业教育的迅猛发展,顶岗实习所存在的法律风险和实习学生的以劳动权益为核心的合法权益受侵害问题日益引发社会关注。本文拟从人权的角度探讨劳动顶岗实习学生的劳动权利内涵,分析实习环节中的学生存在的法律风险,提出保障实习学生劳动权益的机制。

| Abstract: | As an important part of vocational education and the main form of school-enterprise cooperation, internship has become one of the indispensable elements of vocational education development. However, against the rapid progress of vocational education, the subsequent legal risks and infringements on the students＇labor rights among other legitimate rights and interests have hit the public con- sciousnesS. This paper intends to explore the connotation of students＇labor rights in perspective of human rights. It analyzes the poten- tial legal risks during the internship and proposes feasible mechanism for guaranteeing students＇labor rights and interests. |
