| 摘 要： | 隐名股东常常引起当事人之间的纠纷,但又缺乏法律规定.解决隐名股东问题,必须根据纠纷范围采取不同标准,对股东资格进行认定.为规范隐名股东,应当加强和完善公司立法、注意企业维持原则的运用、区别对待民事纠纷与行政执法.

| Abstract: | The problem of dormant shareholders always causes the disputes over the parties, but there is no law to regulate them. to solve this problem, it must take diverse standards according to the scope of the disputes, and identify the qualification of shareholders. In order to stipulate the problem of dormant shareholders, we should strengthen and perfect the litigations about the company, stress the use of maintaining the doctrine about enterprises and deal with civil disputes and administrative enforcement distinctively. |
