论预告登记制度同相关法律制度的冲突与协调

我国不动产预告登记制度确立后,学界大多数参考德国、日本、瑞士、我国台湾等国家和地区的相关规定,从明确预告登记的性质和效力、扩大预告登记的适用范围、明确预告登记的申请人等方面提出了完善我国预告登记制度的建议。这些研究成果虽然为完善我国预告登记制度提供了重大的理论依据,但其大多停留在预告登记制度内部进行研究,并没有运用研究成果进一步协调登记制度与其他相关法律制度之间的冲突。协调我国登记制度与相关法律制度的冲突,既是为预告登记涉及的实证法律问题的解决提供了清晰的思路,也可以从物权、债权、物权化的债权、优先权、诉权等权利协调的理论高度进行初步探索。
