| 摘 要： | 家事劳动的社会经济价值及其公平分配原则是离婚经济补偿权存在的理论基础;夫妻双方书面约定实行分别财产制和夫妻一方在婚姻生活中承担了超过其份额的家事劳动则是取得经济补偿权的前提条件。现行婚姻法关于离婚经济补偿请求权实现的规定有的限制过死,有的含混不清,应予以扩充和细化,以求便于司法实践和更好地保护当事人权益。

| Abstract: | The economic value of housework and the principle of distributing impartially are the theoretical basics of the right for economic compensation of divorce.That husband and wife arrange AA of each property and that one of them bears more housework in marriage are the premise to gain economic compensation.Some regulations about right of claim for economic compensation of divorce in Marriage Law are too limited,Some are vague.Those should be expended and meticulized,which will be easy for legal practice and protect the parties' right and interest. |
