| 摘 要： | 理论上,确定性是司法运作的常态。事实上,司法运作的不确定也经常发生,但往往被忽视。如何对待这种司法现象,一个合理的态度应该是:只要不对司法运作的确定性造成“硬伤”,就可以放任,否则便应当予以禁止或矫正。
