论当代自然法的复兴

自然法思想在西方发展的时间相当长，其经久不衰的影响力证明了该理论在一定程度上符合人类政治法律文化发展的需要。法律不是一个绝对完善、毫无空白的体系，照搬法律条文的审判往往不能得到最优的结果，虽然实证主义仍将法律界定为一个自我规范的独立体系，但当代自然法认为法律与政治、道德将不可避免地产生更为广泛的联系。

Resuscitation of the Natural Law in Contemporary Era

The development of the theories of Natural Law has been last for a long time in the West. Its enduring influence proves that the theories meet the needs of the development of the human political and legal culture to a certain extent. The law is not absolutely perfect, or a system without flaws. Mechanically copying the legal provisions in the trial often lead to unreasonable results. Although the legal positivism still considered the law as an independent self-regulating system, the Natural Law in contemporary era pointed out that the law and politics and moral will have more extensive ties inevitably.
