| 摘 要： | 《中华人民共和国道路交通安全法》第二十四条规定了累计记分制度,提出了交警扣分行为的性质问题。扣分行为是中间行政行为抑或行政处罚行为?文章经分析后认为,扣分并不产生直接法律后果,从行为的过程性来看,扣分行为应当是一种程序行政行为。因此也决定了司法实践中对扣分行为的起诉时机需要特殊对待。

| Abstract: | It put forward the problem of the system of keeping accumulative scores since Law of The People's Republic of China on Road Traffic Safety Act get across.What the action really is?After research,the deducts scores action is a sort of procedure administration action because it do not engender legal effect.So it must make difference in administrative litigation. |
