| 摘 要： | 国内"城中村"改造没有实现多样化,多采用政府主导、开发商出资的模式。其缺陷是存在政府随意性,没有注意保护文化遗产。"城中村"改造应注重保护村民权益,建立村民权益表达机制、利益分享机制、利益纠纷解决机制,以及政府违法行为规制。

| Abstract: | Reconstruction of urban-village models around China include government-led,developer-led,village collective dominant and community stock cooperative model.Through a comparative analysis of the reconstruction of urban-village main models,this paper points out that most domestic models are government-led,the developer contribution,which has government arbitrariness,is easy to overlook the protection of cultural heritage,and fails to realize diversification of reconstruction model.The difficulty of reconstruction of urban-village is the source of funding,and reconstruction does not have to rush to demolitions.Therefore,this paper suggests that we should focus on protecting villagers’ rights,and the ways are to create mechanism for the villagers to express their interests,create benefit sharing mechanism,and create dispute resolution mechanism and regulation government violations. |
