法而有实德外无治——唐甄的"法治"、"德治"思想探微

唐甄认为,要治理好一个国家,一方面要有法可循,随时制法,依法治国.在依法治国中,他特别强调要法而有实,刑自贵始.另一方面,他主张以德治国.在以德治国中,他特别强调德风于世.他从德治具有时空无限性等特性论证了"德外无治"的命题.他认为只有把法治与德治紧密结合起来才能治理好国家.他从"众为邦本"的立场出发,围绕"民本中心论",揭示了法治与德治深刻的经济根源和深厚的人民性.

Law with Content and Non- government without Morality- A Probe into Tang Zhen's Thought of "Rule- by- law" and "Rule- by- morality"

Tang Zhen believes that, on one hand, to govern a country well, one must manage the country according to law and make laws at any time. He, in ruling the country by law, specially stresses the law with content and the criminal law from the beginning. On the other hand, he insists on ruling by morality and emphasizes its influence on the society. From this point of view with temporal and unlimited characters, he proves the thesis of non-governing without morality. He thinks only by connecting rule-by-law with rule-by-morality can one govern a country well. From the standpoint of people serving the nation, centered on "theory of serving the people", he reveals economic source and the deep nature of the people about rule-by-law and rule-by-morality.
