| 摘 要： | 我国有关精神损害赔偿制度的立法存在着三方面的缺陷首先是概念上缺乏权威的解释说明；其次是有关赔偿的范围过窄；第三是赔偿额的计算方法不明确。所以需要进一步加强有针对性的完善。
