| 摘 要： | 随着信息技术的发展,网络经济成为一个新的经济领域。在我国继续改革开放的大环境下,商业方法专利的问题已经无法回避。通过介绍国外商业方法专利的情况和我国的现状,对商业方法专利立法提出一些构想,以期为我国在世界市场经济竞争中取得有利地位作出有益的探索。

| Abstract: | With the development of information technology, the network economy becomes a new economical field. Business Method Patent problem has no way to avoid under the overall situation continuing reforming and opening in our country. This article through the introduction overseas Business Method Patent situation and chinese present situation, and to the Business Method Patent legislation proposed some conception, resides in the advantage take the time as our country in the whole world market economy competition to make the beneficial exploration. |
