从传统伦理道德视角阐释重构我国亲属拒证权问题

亲属拒绝作证权作为现代法治国家的一项重要制度,在许多国家的诉讼法典或证据立法中都有明确规定。目前,我国现行诉讼法虽对此尚未做出相关具体规定,但法学理论界关于是否重构证人拒绝作证权制度的激烈论争却存在已久。本文拟从我国传统伦理文化视角,来阐释重构亲属拒证权的重要现实意义及提出几点重建构想。
