| 摘 要： | 市场经济是信用经济。商事信用是商事主体所具有的经济能力在社会上获得的相应的信赖与评价，商事信用和质量一样是企业的生命。良好商事信用的形成需要制度环境特别是法律制度作为保证。商法是商事信用的基本保障，商事信用的提升离不开商法制度的创新即程序法意义上的商法制度创新如完善商事登记和实体法意义上的商法制度创新如公司人格之否认、自然人破产、信用保险等。

| Abstract: | Market economy is credit economy.Commercial credit is corresponding social trust and evaluation to the economic ability of business entity.Quality as well as commercial credit is the life of enterprises.But erecting good commercial credit needs the institutional environment,especially the law system.Commercial law is the basic safeguards to commercial credit,the upgrade of commercial credit needs the institutional innovation of commercial law system.The specific innovative measures include procedural commercial law measures such as commerce register and substantial commercial law measures such as disregarding of the corporate entity,personal bankruptcy and credit insurance. |
