| 摘 要： | 科层制的政府组织模式需要依法行政,依法行政的效果需要法治评估.理论上看,法治评估应该有三个主体:其一是法治的参与双方,政府和行政相对人;其二是第三方评估.法治评估引进第三方是社会发展的需要、是变管理为治理推行合理的政府与社会关系的需要、是党执政能力提升的表现和根本方略.国外的法治评估一般采用过程参与的模式,中国则采用事后评估的模式,两者孰优孰劣还要经受法治实践的检验.
