试论教师教育权的强制性及其实践意义

教育实践和教师教育权的结构与性质决定,必须在法理上明确教师教育权对相对人具有强制性。从认识到制度层面分析,体罚、心罚或教师怠于管理都是对教师教育权强制性的误读及制度设计上的缺陷所致,教师教育权强制性的缺失也有悖于权利与义务辩证统一的基本法理。教师教育权具有公权力性质,是法定的专业职务权力,这也决定教师教育权具有强制性。
