故意自陷麻醉状态下实施犯罪行为的可罚性研究

随着经济社会的发展,国内故意自陷麻醉状态的行为方式层出不穷,因为该行为在犯罪时丧失了行为的辨认能力或者控制力,导致目前司法界对这一特殊犯罪行为性质的认定众说纷纭。笔者从法律规定、刑法理论等方面展开探讨,阐述了自陷麻醉状态下实施犯罪行为具有可罚性的观点。

Punishable study on the implementation of criminal acts in the state of deliberate self-trapping anesthesia

With the economic and social development,ways of committing the crime in the state of deliberate self-trapping anesthesia emerge one after another in China.Because the criminals lose the ability of identify or control in the state of deliberate self-trapping anesthesia,there are different opinions on cognizing nature of the special criminal acts in judicial circles.The author discusses the problem from legal provisions,criminal law theory and so on,then gives an opinion that the crime in the state of deliberate self-trapping anesthesia should be punished.
