试论教师的批评教育权与体罚的法律边界

近日教育部印发了《中小学班主任工作规定》,提出了班主任的批评教育权。落实教师的批评教育权,必须厘清教育惩戒权与体罚的法律边界。从法理上探讨,教师的教育权是职务行为,教育惩戒权应赋予学校,而不是教师个人。因而,教育惩戒应置于学校的制约和监督之下,在此基础上确立学校教育惩戒制度。教育惩戒制度是法律赋予学校的,通过规范的、可以预知的、适度的处罚,使违规学生受到身体上可以承受的痛苦,以警示其改正不良习惯的制度。

Discussion on Teachers' Right of Criticism and Education and Corporal Punishment in the Legal Boundaries

The Ministry of Education recently issued a " Primary and Secondary Class Teacher Work Regulations",in which the right of criticism and education of teacher is proposed.To carry out the right of teachers,we must clarify the Legal Boundary of the disciplinary authority of education and punishment.Discussing from the legal perspective,we believe that the right of teacher education is the duty behavior;school should be given the disciplinary authority of education instead of individual teachers.Thus,Education discipline should be placed under the control and supervision of school.On this point,the school disciplinary system is established.The school disciplinary system is given to school by law,Through standardized,predictable,and appropriate penalties,students are subject to bearable physical abuse and be warned to rectify the bad habit.
